Litigation practice

Incor Alliance effectively represents the interests of clients at all stages of judicial and pre-judicial trial in state arbitration courts and courts of general jurisdiction in Russia, and also in the judicial institutions of Switzerland, Austria and the international commercial arbitration institutions. Together with our partner companies from foreign countries, Incor Alliance is able to represent interests of clients in the judicial bodies of Great Britain, Germany, Cyprus, the United States and a number of other countries.

Incor Alliance team members specialize in disputes regarding tax issues, corporate disputes, disputes over ownership rights, land disputes, shareholders disputes, disputes over asset separation, and disputes arising from foreign trade activities.

A separate specialization of the company is cross-border judicial disputes arising simultaneously in the territory of several states; or falling under the jurisdictions of courts in different countries; or arising in the territory of one state but with respect to the citizens, companies or property located in the territory of another state. Most often such cases arise from special arbitration clauses or from provisions of shareholders agreements, or if a transaction with the assets located in one state moves to a jurisdiction of another state.

Incor Alliance assists its’ clients with judicial acts enforcement, sister-state judgment enforcement, by interacting with Russian and foreign bailiffs services, and also facilitates the procedure of recognition of the decision of a judicial body of one state in the territory of another state where the respective enforcement of a judicial decision is requiredIncor Alliance experts have extensive experience in judicial representation on bankruptcy matters, in customs disputes, disputes arising from the construction business, legal support in the courts regarding disputes arising from election campaigns, and in cases of damaged business reputation, infringed honor and dignity. In the Russian Federation, Incor Alliance most often represents clients' interests in the Federal arbitration courts of the Ural, West-Siberian, and Northwest districts, and the Federal arbitration court of Moscow.

1. CJSC “Permgaztechnologija” – successful support of litigation regarding the recognition of ownership to a gas pipeline/branch to the Perm state district power station, on annulment of the transaction on the basis of malevolent collusion of the persons, compensation in the form of unjust enrichment based on the illegal use of a gas pipeline.
2. Joint-Stock Company "Basalt" – successful support of a number of judicial disputes regarding reclaiming of the company's shares from the third parties
3. Airline AUSTRIAN (Austrian Airlines) – ongoing support of the client's litigation in Russia.
4. Pre-judicial settlement of a dispute between an Austrian hotels management group and a group of contractors who was doing construction work for them.
5. Successful interest representation of a Russian client in Austrian courts, in the Supreme Court of the Russian Federation and in the international commercial arbitration of London regarding a dispute over the seizure of funds owned abroad.
6. Successful interest representation of a Russian bank in a case on recovery of a debt, including the debt of Russian municipalities.
